Malaysian MOH is Evaluating the Vape Registration Program
The Malaysian Ministry of Health (MOH) is currently in the evaluation phase for smoking product registrations, including for vape products, submitted under the Control of Smoking Products for Public Health Act 2024 (Act 852). Dr. Hairul Nizam Abd Hamid, senior principal assistant director at the MOH’s disease control division, stated that the registration window, open from October 2024 to April 2025, has closed, with approvals anticipated by October 1, 2025.
“At the moment, we’ve not approved any product registrations… Come October 1, any unregistered products will not be allowed on the market,” Dr. Hairul Nizam announced during a public briefing. He confirmed several vape products are already under review. Once approved and issued an MOH registration certificate, these items can be sold through authorized outlets like convenience stores or licensed specialty vape shops, but not at informal venues like night markets.
Dr. Hairul emphasized that all retail premises must ensure the smoking products they stock are MOH-registered. “If there’s no certificate from MOH, local authorities like DBKL (Kuala Lumpur City Hall) can reject the premise’s licence,” he warned. He also reminded local authorities about spatial regulations for licensing, requiring shops to be at least 40 meters from higher learning institutions and three meters from kindergartens or general commercial areas like 7-Eleven.
All products submitted for registration must include laboratory test reports and will be screened for prohibited or suspicious substances, such as illicit drugs like “magic mushrooms,” leading to outright rejection if found. Dr. Hairul clarified that e-cigarette devices sold without any substance or chemical ingredients do not fall under Act 852, as the MOH licenses smoking products (including e-liquids) but not standalone “devices,” which are overseen by the Ministry of Domestic Trade and Cost of Living (KPDN) for aspects like Sirim certification.
