Alabama Lawmaker Proposes Ban on Vaping in Public Places

An Alabama lawmaker has pre-filed legislation aiming to prohibit vaping in public places across the state. Senator Gerald Allen (R-Tuscaloosa) introduced Senate Bill 9, which seeks to amend the Alabama Clean Indoor Air Act by adding “electronic nicotine delivery system” to its list of prohibitions.

If passed, the bill would ban vaping in public spaces such as restaurants, malls, and sports facilities. “That needs to be a priority of ours to make sure the citizens know that when they’re going into a public place, they cannot vape,” stated Sen. Allen. He highlighted misinformation and a lack of knowledge about the dangers of e-cigarettes as key problems.

The Alabama Department of Public Health supports such measures, warning that secondhand vape aerosol contains nicotine, ultra-fine particles, and other potentially harmful substances that can increase risks of lung damage and cardiovascular issues. While Alabama has existing restrictions on vape sales, particularly to minors, this bill would significantly expand public use prohibitions. If it becomes law, Senate Bill 9 would take effect on October 1, 2026.
