Belarus Holds Public Discussion on Proposed Vaping Regulations
The Belarusian state food industry concern Bellegpishcheprom has recently concluded a public discussion on a draft law that seeks to tighten requirements for the production, circulation, and consumption of non-tobacco nicotine-containing products, liquids, and tobacco smoking systems. According to Office Life, the results of the discussion have been published on the Legal Forum of Belarus.
The draft law proposes stricter requirements for the sale of e-cigarettes and bans their use on the porches of residential apartment buildings and adjacent territories. During the public discussion, Bellegpishcheprom received 44 messages from 20 users, which were carefully studied by the concern.
Many participants suggested significantly increasing administrative responsibility for the sale of tobacco and non-tobacco nicotine-containing products, liquids, and electronic smoking systems by individuals who are not registered as individual entrepreneurs. They also proposed tightening responsibility for violations of established prohibitions in wholesale trade. In response, the developers of the draft law made corresponding adjustments to Articles 13.21 and 13.22 of the Administrative Code.
Bellegpishcheprom accepted proposals to allow importers to mark tobacco products imported into the country with excise stamps both outside Belarus (at their places of manufacture) and within the country, in locations determined by the State Customs Committee. The authors of the draft law also incorporated other user suggestions related to editorial and technical amendments.
However, proposals to allow online sales of liquids for electronic smoking systems, electronic smoking systems themselves, and tobacco consumption systems did not find support. The authors of the draft law also rejected suggestions to lift the ban on advertising electronic smoking systems and tobacco consumption systems, including in duty-free shops, and to ease requirements for applicants seeking a license for wholesale trade in non-tobacco nicotine-containing products, liquids, and electronic smoking systems. These proposals were deemed inconsistent with the goals and spirit of the draft law.
