Belarus Drafts New Law to Tighten Vape and Nicotine Product Regulations

Belarus has developed a draft law proposing new comprehensive rules for the circulation of nicotine-containing products, including electronic cigarettes (vapes) and their liquids. The bill, titled “On Tobacco Raw Materials, Tobacco, Non-Tobacco Nicotine-Containing Products, Electronic Smoking Systems and Liquids for Them, Systems for Tobacco Consumption,” aims to define key terms, establish regulatory scope, and outline state control measures for production, trade, and consumption.

Key proposals include restricting the production, import, and wholesale trade of tobacco and non-tobacco nicotine products to legal entities only. Individual entrepreneurs would be limited to the retail sale of traditional tobacco but not vapes or their liquids. Obtaining wholesale or retail licenses will require meeting strict criteria, such as minimum charter capital, adequate warehousing, and, for wholesalers, at least five years of operational experience.

The draft law also seeks to limit “samozames” – the practice of individuals self-mixing e-liquid ingredients (like glycerin, propylene glycol, and flavorings), which authorities state allows for tax evasion. Additionally, the bill proposes further restrictions on public consumption, including a ban on vaping on the porches of residential buildings and in dormitories. The document is currently undergoing public discussion until June 27th on Belarus’s Legal Forum.
