Petro Government Explores “Contaminating Agent” Levy as Part of Fiscal Revenue Plan

The Colombian Ministry of Hacienda (Finance) is exploring the possibility of introducing new taxes on vaping products (e-cigarettes), potentially classifying them as “contaminating agents” to bolster national fiscal revenue. This initiative is part of a broader roadmap unveiled by Finance Minister Germán Ávila, aimed at increasing the country’s income, which will require in-depth study to establish collection mechanisms.

While taxes on e-cigarettes for consumption or health contributions have been previously discussed or implemented, this new proposal seeks to specifically target vapes due to their environmental impact. Past legislative projects and tax reforms in Colombia have considered adjusting the VAT (Value Added Tax) for these electronic devices up to 20%. Currently, under the tax statute, e-liquids used in vapes are already subject to VAT, and restrictions are in place to ensure sales are only to adults.
