Delaware Enacts Law Banning Smoking in Vehicles with Minors
Delaware Governor John Carney signed House Bill 118 into law on Wednesday, effectively banning smoking in any vehicle occupied by someone under the age of 18. The new legislation aims to protect minors from the harmful effects of secondhand smoke exposure in the confined space of a vehicle.
The bill signing took place at Wilbur Elementary School in Bear, where students and teachers have advocated for such a law for over a decade. Their persistent efforts have now come to fruition with the enactment of this important public health measure.
House Bill 118 references the Centers for Disease Control and Prevention‘s assertion that there is “no safe level of exposure to secondhand smoke” and that “even brief exposure can cause immediate harm.” This underscores the need to shield children from the detrimental impact of tobacco smoke, even in private vehicles.
The new law applies to smoking from any tobacco source, including cigarettes, cigars, and vapes. It covers all motor vehicles driven on public roadways, with limited exceptions for those powered by animals, humans, electric bicycles, off-highway vehicles, special mobile equipment, and farm equipment.
While the law establishes a civil citation for those caught violating the smoking ban, it does not authorize law enforcement officials to stop or search vehicles solely based on suspected violations. This provision strikes a balance between enforcing the new regulation and respecting individual privacy rights.
The passage of House Bill 118 marks a significant step forward in safeguarding the health and well-being of Delaware’s children. By reducing their exposure to secondhand smoke in vehicles, the state aims to create a healthier environment for its youngest residents and set a positive example for other jurisdictions to follow.
