In a move to align with European Union directives, the Estonian parliament, Riigikogu, has passed amendments to the Tobacco Act, prohibiting the sale of flavored and aromatic heated tobacco products in the country. The bill, which was adopted on Wednesday, April 23, received overwhelming support from the deputies, with 68 voting in favor, seven against, and one abstention.

The amendments introduce the term “heated tobacco product” into the law and set requirements for its composition, labeling, and packaging. The special exception allowing flavored versions and unique labeling of heated tobacco products has been abolished across the European Union.

The bill also introduces penalties for failure to notify authorities about tobacco products or related products. Individuals found in violation could face fines of up to 300 penalty units, while legal entities could be fined up to 32,000 euros.

During the discussion, several amendments were made, ensuring that the law covers all tobacco products and their parts, regardless of the technology used, and limits the volume of the capsule with tobacco filling. Manufacturers or suppliers introducing new tobacco products or devices to the Estonian market must submit an electronic notification to the Health Board at least six months before the launch, including a detailed description of the device and instructions for use.

Heated tobacco products, which are distinct from e-cigarettes, combine an electronic device with a special cigarette. The tobacco is heated to 350 degrees, producing an aerosol that the user inhales instead of smoke. Currently, only about 0.2% of the adult population in Estonia uses heated tobacco products.
