Indonesia Jakarta Proposes Stricter Smoke-Free Zones & Vape Ad Penalties
The Provincial Government of DKI Jakarta has officially proposed a strengthening of its Smoke-Free Zones (KTR) through a Draft Regional Regulation (Raperda). Presented to the Jakarta DPRD (Regional People’s Representative Council) by Governor Pramono Anung on May 27, 2025, the bill aims to expand smoke-free areas and introduce significantly tougher sanctions for violations, including hefty fines for tobacco and vape advertising within these zones.
While Jakarta previously had smoke-free regulations under Governor’s Regulations (Pergub), elevating these to a Regional Regulation (Perda) will give them greater legal force. The draft Raperda KTR expands the list of designated smoke-free locations to include healthcare facilities, educational institutions, children’s playgrounds, places of worship, public transport, sports facilities, workplaces, integrated public spaces, and venues holding crowd permits. Specific public places like modern and traditional markets, hotels, apartments, restaurants, recreation and entertainment venues (including karaoke, nightclubs, live music cafes), and transport hubs (bus stops, terminals, stations, ports, airports) are also covered. The no-smoking area extends to the outermost boundary or dripline of buildings.
The proposed sanctions are notably stricter. Individuals caught smoking in KTR areas face a Rp 250,000 fine or on-the-spot social work. Advertising, promoting, sponsoring, selling, or buying cigarettes/vapes within KTRs could result in a Rp 1 million fine. Specifically, advertising or sponsoring tobacco/vape products in these zones could attract a substantial Rp 50 million fine, while displaying such products could lead to a Rp 10 million fine. Enforcement will be carried out by the Satpol PP (Public Order Agency).
Governor Pramono Anung clarified that the Raperda does not aim to completely ban smoking in Jakarta but to regulate it to protect public health, especially vulnerable groups like children under 21 and pregnant women. Smoking will still be permitted outside designated KTR areas. The government also plans to enhance public education on these regulations.
