Maryland Bans Most Flavored Disposable E-Cigarettes
Maryland has taken a significant step to combat youth vaping by banning the sale of most flavored disposable e-cigarettes. State Comptroller Peter Franchot announced that retailers are no longer permitted to sell disposable e-cigarettes in flavors other than tobacco or menthol.
“These products are sadly the most popular among our children, and we cannot allow them to remain on the market any longer,” Franchot stated. This state-level action aims to close a loophole that emerged after the U.S. Food and Drug Administration (FDA) banned most flavored e-cigarette cartridges but did not initially extend the same restriction to disposable devices, which then surged in popularity among youth.
The Comptroller’s office will inspect Maryland’s over 8,400 licensed tobacco retailers for compliance. If banned flavored disposable products are found, they could be seized, and stores may face disciplinary action. Franchot expressed hope that retailers would voluntarily remove these items, noting that tobacco- and menthol-flavored disposables remain available for adults attempting to quit smoking. He also anticipated potential legal challenges from manufacturers but affirmed the state’s belief in its legal standing, as these flavored e-cigarettes are not FDA-approved. Further legislative proposals to decrease e-cigarette use by minors are also planned.
