Mississippi to Ban Unauthorized Vape Products in October

A new Mississippi law, House Bill 916, will take full effect on October 1st, restricting the sale of all vape products in the state to only those authorized by the U.S. Food and Drug Administration (FDA). This measure aims to align the state’s retail market with federal standards and curb the sale of unregulated products.

Under the new law, the Mississippi Commissioner of Revenue will publish a statewide directory on October 1st listing all legally approved electronic nicotine delivery system (ENDS) products. This includes vapes, e-liquids, and devices that have either received FDA marketing authorization, have a pending Premarket Tobacco Product Application (PMTA), or have had a denial order stayed or overturned.

Retailers will have a 60-day grace period to sell or remove any products not listed in the directory. After this period, it will be illegal to sell unlisted vape products, which may then be seized and destroyed. While supporters believe the law will reduce youth access and ensure product safety, critics argue it could limit consumer choice and negatively impact small vape shops.
