Nebraska Legislature to Hold Public Hearings on Vape Flavors and Advertising Bans
The Nebraska Legislature’s General Affairs Committee is set to hold public hearings on two bills aimed at restricting the sale and advertising of electronic nicotine delivery systems (ENDS), commonly known as e-cigarettes / vapes. The hearings for LB285 and LB688, both introduced by Senator Dan Lonowski of Hastings, will take place on Monday, February 24, 2025, at 1:30 pm in Room 1023 on the first floor of the Capitol.
LB285: Banning Most Vape Flavors
LB285 seeks to prohibit the sale of most flavored e-cigarette products in Nebraska, with the exception of tobacco and menthol flavors. The bill aims to reduce the number of children who become addicted to these products and curb the overall sale of e-cigarettes to both children and adults.
The Group to Alleviate Smoking Pollution (GASP) plans to ask the committee to amend the bill to include menthol as one of the prohibited flavors. Statistics show that menthol is the preferred flavor among most Black and Hispanic children and adults, while candy and fruit flavors are more popular among White children and adults. GASP argues that the law should protect all children and adults equally by banning all flavors simultaneously, rather than targeting only the flavors preferred by a specific demographic.
LB688: Prohibiting Vape Advertising
LB688 aims to prohibit the advertising of electronic nicotine delivery systems in Nebraska. By ending the advertising for these addictive products, the bill seeks to reduce the number of children and adults who become and remain addicted to them.
Current Age Restrictions
Under current Nebraska law, individuals must be at least 21 years old to purchase and use tobacco and e-cigarette products. The proposed bills, LB285 and LB688, aim to further restrict access to these products and reduce their appeal to youth by limiting flavors and advertising.
Implications
If passed, these bills could have significant implications for public health in Nebraska, particularly in terms of reducing youth addiction to e-cigarettes. However, the proposed restrictions may also face opposition from the e-cigarette industry and some adult consumers who argue that flavored products and advertising are essential to their business and personal choices.
