Ohio Supreme Court Weighs State Crackdown on Flavored Vapes

The Ohio Supreme Court heard oral arguments on Tuesday to determine if state officials can legally halt the sale of unauthorized flavored e-cigarettes. The case centers on whether Ohio can use its consumer protection laws to enforce federal tobacco standards, directly impacting how local governments combat youth nicotine use.

Nearly one in five Ohio high schoolers report using e-cigarettes within the past 30 days. While the FDA has banned most flavored tobacco products, attorney Marisa Katz of the Public Health Law Center noted that federal enforcement remains limited, leaving states to manage local sales.

The legal battle began in 2024 when the Ohio Attorney General’s office filed civil lawsuits against several retail shops, including Elev8 Smoke Shop in Cincinnati, for selling unauthorized flavored vapes. Appellate courts have since split on whether federal law preempts state-level intervention.

While Governor Mike DeWine has long advocated for stricter tobacco controls, state lawmakers have resisted a statewide flavor ban. In response, several Ohio cities enacted local bans. However, state legislators passed a preemption law to block these municipal regulations, a move currently being challenged by cities under home-rule constitutional provisions.

The Ohio Supreme Court is now poised to rule on both the retailer lawsuits and the municipal preemption case, decisions that will shape the future of tobacco regulation across the state.
