Paraguay Passes Law to Regulate and Tax Vaping Products
The Paraguayan Congress has passed a new law establishing a comprehensive regulatory framework for electronic nicotine delivery systems (ENDS), similar nicotine-free systems (SSSN), and other vaping products. The bill, which has been sent to the Executive Branch for promulgation or rejection, aims to protect public health by controlling the import, production, sale, consumption, and advertising of these devices and their liquids, regardless of nicotine content.
A key provision of the new law is a ban on the sale of all vaping products to minors. It also introduces a significant excise tax of 24%, aligning the tax rate for vapes with that of traditional cigarettes. Senator Derlis Maidana, president of the Legislation Committee, highlighted that this tax structure was a key point of difference between the versions passed by the Chamber of Deputies and the Senate, with the Senate’s version ultimately being ratified.
The legislation received broad support, including from the Ministry of Public Health and the Ministry of Economy and Finance. Senator Natalicio Chase of the Finance and Budget Committee confirmed their endorsement. The law also stipulates that 40% of the revenue collected from fines for violations will be allocated to prevention campaigns.
During the debate, Senator Esperanza Martínez expressed deep concern over the growing use of these products among children and adolescents, stressing the need for strict preventive measures. “Someone who starts smoking at 9, 11, or 14 will probably be a heavy smoker with serious health consequences,” she stated, insisting on high taxes consistent with regional policies.
