Philippine Senator Win Gatchalian has emphasized the need for a dedicated law to further regulate the sale, packaging, advertisement, and distribution of e-cigarettes, vapes, and other electronic nicotine and non-nicotine delivery systems (ENDS/ENNDS) in the country. His call comes amidst growing global concerns over the safety of these products, highlighted by issues faced by companies like Juul Labs in the United States.

Gatchalian stated he is preparing a bill to address how these products are marketed, particularly their appeal to children and adolescents due to online availability, colorful packaging, attractive flavors, and the absence of tobacco odor. “Inadvertently or not, these products are marketed in such a way that they are enticing to minors… luring a new generation… into nicotine addiction,” he said. He also stressed the need for a regulatory framework to verify manufacturers’ claims that e-cigarettes are safer or healthier alternatives to traditional cigarettes, ensuring public awareness of potential health effects.

This push for regulation follows claims by Juul Labs during a Senate hearing that its products are “healthier” and aid smoking cessation, an argument made in the context of proposed excise tax increases on all e-cigarette products. However, the U.S. FDA has previously warned Juul for illegally marketing its product as a safer alternative without scientific substantiation.
