Poland to Ban Sale of Flavored Heated Tobacco Products
Manufacturers and Sellers to Have 9 Months to Prepare for New Regulations
The Polish Sejm is expected to pass a law introducing a ban on the sale of flavored heated tobacco products in the near future. The Sejm’s health committee supported this solution on Wednesday, February 19.
According to the new regulations, manufacturers and sellers of tobacco products will have nine months to prepare for the changes. The health committee adopted the government’s draft law, which aims to implement an EU directive, with 17 members in favor, two against, and two abstaining. No amendments were made to the draft prepared by the Ministry of Health.
Deputy Minister Wojciech Konieczny explained to the MPs that the nine-month transition period for manufacturers and sellers of flavored heated tobacco products is due to the fact that the Office for Chemical Substances has six months to issue an opinion on a product submitted for sale.
The proposed 9-month transition period will ensure that manufacturers are able to meet the requirements of the mentioned procedure for notifying new innovative tobacco products explained Konieczny.
In recent years, sales of heated tobacco products have increased by over 2000 percent. According to data from the European Commission, the total share of these products in the EU tobacco market currently stands at 3.33 percent.
The authors of the draft wrote in the justification that due to the emergence of a “significant change in circumstances,” it is necessary to adopt an appropriate delegated act at the EU level to lift the exemption from the ban on the use of characteristic flavors in heated tobacco products.
The Sejm is set to address the draft law at a plenary session on Thursday, February 20.
