Poland Bans Flavored Heated Tobacco Products, E-Cigarette Restrictions to Follow

Poland’s President Andrzej Duda signed an amendment to the country’s Tobacco Act on April 01/2025, prohibiting the sale of flavored heated tobacco products. The new regulations will come into force this April, giving manufacturers and retailers nine months to adapt to the changes.

The amendment aligns with an EU directive that member states were expected to implement by October 23, 2023. According to European Commission data, sales of heated tobacco products have skyrocketed by 2009% in recent years, accounting for 3.33% of the total tobacco product market in the European Union.

In addition to the ban on flavored heated tobacco products, the Polish government is also working on further restrictions targeting the sale of traditional e-cigarettes. The Sejm, Poland’s lower house of parliament, is currently considering another government draft amendment to the Tobacco Act.

Prepared by the Ministry of Health, the draft prohibits the sale of all types of electronic cigarettes and refill containers to individuals under 18 years of age, regardless of whether the product contains nicotine or not. This matter is currently at the stage of notification to the European Commission.

The move to restrict the sale of e-cigarettes and flavored heated tobacco products reflects a growing concern about the potential health risks associated with these products, particularly among minors. By implementing these regulations, Poland aims to protect public health and reduce the appeal of these products to young people.

As the country prepares for the new regulations to come into force, manufacturers, retailers, and consumers will need to adapt to the changing landscape of the tobacco and e-cigarette market in Poland.
