Calls for Dialogue Amid Claims of Targeting Legal Businesses

Representatives of Poland’s vaping industry have issued a formal appeal to Prime Minister Donald Tusk, urging an end to what they describe as excessive administrative pressure from recent nationwide inspections conducted by tax and customs services. The industry is calling for a halt to the current wave of controls and the initiation of constructive dialogue.

In their appeal, industry leaders stressed they do not oppose necessary checks aimed at combating illegal trade. However, they argue the current inspections disproportionately target legally operating businesses, leading to market destabilization and eroding trust in state institutions. They emphasize the need for proportionality and equal treatment for all entrepreneurs, as guaranteed by Polish and EU law.

The letter suggests the timing, potentially linked to election campaigns, should not justify singling out a regulated industry for “repression and stigmatization.” The authors contend that the authorities’ actions appear to ignore available scientific data on vaping and its real-world health and economic impacts. They warn that attempting to eliminate the legal sector through mass inspections and penalties could inadvertently push the market into a grey zone, compromising product quality control and consumer safety.

The industry presented three key demands to the Prime Minister:

  • suspend the excessive controls pending clear legal justification
  • initiate dialogue with the sector based on principles of good lawmaking
  • and uphold proportionality and equal treatment.

They urged for policy based on facts and consultation, not “political calculation.”
