Russia Imposes Criminal Penalties for Unmarked Vapes

A new law took effect in Russia on August 3rd, introducing criminal liability for the circulation of unmarked nicotine-containing products, including vape liquids. This measure extends criminal penalties, previously focused on traditional tobacco, to all nicotine products lacking special government-mandated marking.

Under the new law, producers and sellers who violate these marking rules face severe penalties, including fines of up to 500,000 rubles, forced labor, or imprisonment for up to three years, plus additional fines. Criminal liability applies when the value of the unmarked products exceeds 100,000 rubles (“large scale”), with stricter penalties for amounts over one million rubles (“particularly large scale”). The law also introduces sanctions for creating or using counterfeit identification means and excise stamps.
