UK Government Announce Disposable Vape Ban Update
The UK government will provide long-awaited details on the proposed single-use vape ban this Friday, September 6th, ending speculation about the scope and timing of the anticipated legislation that has left retailers and suppliers guessing. Better Retailing has learned from sources at a leading vape distributor that the government will likely confirm the expected April 1st, 2025 date for the ban to come into force.
Industry Seeks Clarity on Ban Details
Several companies across the vape industry, including Phoenix 2 Retail and JUUL, have reported receiving no information from the government since July’s election, which left the fate of some previously tabled legislation potentially up in the air. The industry has largely been working on the assumption of the April 1st introduction of the ban, with a six-month lead-in period beginning on that date during which retailers must end their sales of single-use vapes.
While the government has already issued guidance on the definition of ‘single-use’ vapes to be affected by the ban, a vape distributor source told Better Retailing that they are still seeking clarification from Trading Standards in case of ambiguity in any upcoming legislation. The source stated, “We are putting all of our products through for compliance opinions from Trading Standards, and where possible with CTSI (Chartered Trading Standards Institute).”
Labour’s Version of the Bill Expected to Match Previous Restrictions
The announcement is expected to confirm that Labour’s version of the bill will contain the same restriction the former bill introduced by the Conservative government. Powers to restrict vape displays, packaging, and flavors, as well as the retained so-called ‘smoke-free generation’ measures from the previous government, will likely be set out at a later date by a minister and will be subject to consultation.
A separate source close to the matter revealed that some government departments are interested in briefing ministers on the merits of a vape licensing system, a measure that was not under consideration by the previous Conservative government.
Disposable Vape Ban Introduced Through Existing Legislation
An ACS spokesperson emphasized to Better Retailing that the disposable vape ban is being introduced through existing legislation, specifically secondary regulations, while the tobacco and vapes bill will be introduced on its own through a separate bill. This distinction highlights the different legislative paths being taken to address various aspects of vaping regulations in the UK.
As the government prepares to provide an update on the disposable vape ban this Friday, retailers and suppliers eagerly await the confirmation of key details to plan their operations accordingly and ensure compliance with the forthcoming regulations.
