Wisconsin New Law Banning Sale of Most Vape Products
A new state law has taken effect in Wisconsin as of July 1st, effectively banning the sale of most popular vaping products that have not received authorization from the U.S. Food and Drug Administration (FDA). The law prohibits retailers from ordering new, unapproved vaping products and sets a deadline of September 1st for them to clear existing inventory from their shelves, after which they could face fines of $1,000 per unlisted item sold.
The legislation restricts the sale of a wide range of items, including open pod systems, box mods, disposables, e-juices, pods, and coils, unless they have received FDA premarket approval. Supporters of the ban argue it is designed to protect children from the harms of vaping.
However, the new law has sparked significant concern among local vape shop owners, who fear for their businesses’ survival. Destiny Scott, manager of Trolls Vape & Smoke shop in Fitchburg, estimates that the banned products account for about 50% of her business. “We are going to lose a lot of money, a lot of people, a lot of good customers,” she said. Amber Crawford, owner of Faze’s Tobacco in Menomonie, voiced similar fears, stating the banned items represent about 70% of her revenue and that the law could lead to job losses and store closures. Crawford also expressed concern that the law removes a tool that has helped her customers switch from combustible cigarettes to vapor products, which they attest has made them feel much better.
