Wisconsin Vape Shops Await Ruling on Product Ban Law

A group of Wisconsin vape shop owners, organized as WiscoFAST, is anxiously awaiting a federal judge’s ruling on their lawsuit against a new state law set to ban most vaping products by September 1st. The law restricts sales to only those products that have received authorization from the U.S. Food and Drug Administration (FDA), a list that currently excludes the vast majority of items sold in vape shops, particularly flavored e-liquids.

WiscoFAST members held a closed-door session to discuss their next steps after a recent court hearing in Madison. “It’s vitally important that our members are all on the same page… there are hundreds of thousands of consumers in this state that want to know what is going on with these products as well,” said Zach Rozenboom, a WiscoFAST member and owner of The Supply Plus.

Tyler Hall, owner of Johnny Vapes and president of WiscoFAST, testified at the hearing, explaining the devastating impact the law would have on the state’s 3,000 small vape businesses. He argued the law creates an unfair market, suggesting that powerful interests like “big tobacco” and large convenience store chains like Kwik Trip are pushing for a monopoly. “We are gonna go down swinging… we are not gonna stop fighting,” Hall stated. The judge is expected to rule before the September 1st deadline.
