Mexican Permanent Commission Declares E-Cigarette and Fentanyl Ban Constitutional
Constitutional Reforms Prohibit E-Cigarettes, Vaping Devices, and Illicit Fentanyl Use
The Permanent Commission of the Congress of the Union, in its session on Wednesday, declared the addition of a fifth paragraph to Article 4 and a second paragraph to Article 5 of the Political Constitution, which prohibit electronic cigarettes, vaping devices, and the illicit use of fentanyl.
Senator Gerardo Fernández Noroña (Morena), acting as the president of the Permanent Commission’s Board of Directors, announced the declaration after receiving 22 affirmative votes from the majority of the state legislatures and Mexico City.
The secretariat of the Board of Directors, Deputy Magdalena del Socorro Núñez Monreal (PT), read the communication from the Senate of the Republic and certified the count of affirmative votes on the draft decree. She informed that 22 affirmative votes were received from the legislatures of Baja California, Campeche, Chiapas, Colima, Durango, Hidalgo, Mexico, Michoacán, Nayarit, Oaxaca, Puebla, Quintana Roo, San Luis Potosí, Sinaloa, Sonora, Tabasco, Tamaulipas, Tlaxcala, Veracruz, Yucatán, Zacatecas, and Mexico City.
The constitutional reforms establish that, to guarantee the right to health protection, the law will sanction all activities related to electronic cigarettes, vaping devices, and other similar systems or devices specified by law, as well as the production, distribution, and sale of toxic substances, chemical precursors, the illicit use of fentanyl, and other unauthorized synthetic drugs.
Furthermore, the profession, industry, domestic or foreign trade, work, or any other activity referred to in the fifth paragraph of the previous Article 4 is prohibited.
The declaration has been sent to the Federal Executive for its constitutional effects, following the approval by the majority of the state legislatures and Mexico City.
