Bulgaria Moves To Complete Ban on Vapes in 2025

Bulgaria, as a member of the European Union, has been regulating vapes under the European Directive since March 2025. The legal framework sets limits on nicotine concentration in e-liquids, tank and bottle volumes, and requires leak-proof protection and safe filling mechanisms. Packaging must also include a mandatory warning about nicotine’s addictive nature, occupying at least 30% of the label surface.

However, Bulgaria has taken additional steps beyond the minimum requirements of the Directive. Since March 2023, vape liquids containing nicotine have been subject to excise duty like tobacco products. From October 2023, all nicotine products must bear a tax stamp, and this requirement extends to some nicotine-free liquids from 2024 to regulate commerce.

In July 2024, the Bulgarian parliament amended the Child Protection Act, explicitly prohibiting the use of vapes (with and without nicotine) and heated tobacco products by individuals under 18 years of age.

On February 12, 2025, the National Assembly approved at first reading a complete ban on the offering, sale, distribution, and advertising of vapes – both disposable and reusable, regardless of nicotine content. The rationale behind this move includes the ineffectiveness of existing restrictions on children’s access to vapes and the risks associated with unregulated substances in e-liquids. A second reading is expected in spring 2025, with parties announcing their intention to introduce additional amendments to strengthen control over online trade and the illegal market.

Sociologists and addiction specialists have warned that a complete ban may lead to an increase in unregulated trade, particularly online, where numerous websites already operate beyond the control of authorities. If the ban is implemented, Bulgaria could become the second EU country after Belgium to impose such strict measures on vapes. However, legal disputes with the EU are possible if the ban is deemed to violate trade principles.

As of March 2025, Bulgaria is in a transitional period, with vapes still being legal. However, with the bill adopted at first reading, the country is moving towards a complete ban on these products.
