Dutch Doctors Threaten Snapchat Over Illegal Vape Sales
Doctors in the Netherlands are threatening legal action against social media platform Snapchat, holding it responsible for facilitating the illegal sale of vapes, particularly to young people. This move comes after a ban on disposable vapes with sweet flavors took effect in the Netherlands on January 1, 2024, permitting only tobacco-flavored products in an effort to discourage youth vaping.
Despite the ban, recent figures from Statistics Netherlands (CBS) show almost 8% of 12 to 18-year-olds report vaping, often accessing illegally sold flavored vapes through social media channels like Snapchat. Doctors from Leiden University Medical Center, among others, have formally demanded via lawyers that Snapchat take action within 14 days to prevent these illicit sales.
Bart Schermer, Professor of Law and Digital Technology, told RTL News that while the doctors’ initiative is a good “moral appeal,” Snapchat is generally not liable for user content unless specifically informed, and has no general obligation to proactively scan all posts. However, he acknowledged that platforms have a duty of care and social responsibility, especially given the profits made and the health risks to young people. Snapchat does have a policy for reporting messages, which can lead to moderation.
