Hanover County, Virginia Restricts New Vape & CBD Stores
Hanover County, Virginia, has approved a new zoning ordinance amendment that imposes significant restrictions on new businesses primarily selling vapes, hemp, and CBD products. The new rules, approved by the Hanover Board of Supervisors in late August, are a response to the increasing number of such stores and resident complaints.
A key provision of the new regulations is that any new “recreational substances” store must be located at least one mile from the nearest school. The ordinance defines these stores as those dedicating 15% or more of their display space to tobacco products, vaporizers, hemp, CBD, or kratom. Previously, vape stores were a by-right use in commercial and industrial districts.
Under the new rules, these businesses are now restricted to B-2, B-3, M-1, and M-2 zoning districts and will require a conditional-use permit, which must be approved by the Board of Supervisors on a case-by-case basis. Additional standards include:
- A half-mile buffer from municipal parks.
- A 2,000-foot separation from existing vape and CBD shops.
- Restricted operating hours from 9 a.m. to 8 p.m.
- New standards for interior and exterior lighting.
Existing vape and CBD specialty stores are grandfathered in and considered “non-conforming uses,” meaning they can continue to operate in their current locations but cannot expand. County supervisors described the regulations as a necessary step to safeguard the community, particularly children, while acknowledging that a multi-faceted approach involving health officials and law enforcement is still needed.
