New Jersey Bill Proposes Tripling Fines for Underage Tobacco and Vape Sales
New Jersey is considering a significant increase in penalties for retailers caught selling tobacco and vaping products to individuals under 21. A new bill, sponsored by Senator Joseph F. Vitale, aims to strengthen enforcement and curb underage access to nicotine products by sharply raising fines for violations.
Under the proposed legislation, the fine for a first-time violation would triple from the current $250 to $750. A second offense would carry a $1,500 penalty, and third or subsequent violations would result in a $3,000 fine. For repeat offenders, the Division of Taxation could also suspend or revoke their retail licenses following a municipal hearing, adding a substantial business risk for non-compliance.
Beyond punishment, the bill aims to bolster prevention and accountability. Five percent of the collected fines would be allocated to the New Jersey Department of Health to fund education and outreach programs on the dangers of vaping and illegal sales. Additionally, the Division of Taxation would be tasked with creating a system for retailers to report their compliance efforts and an anonymous mechanism for citizens to report suspected violations.
The legislation broadens the legal definition of a “tobacco product” to include not only items containing or derived from nicotine but also vapor products, rolling papers, blunt wraps, and related accessories. This ensures that the stricter penalties apply across the full spectrum of modern nicotine and tobacco-related items. Products approved by the U.S. Food and Drug Administration (FDA) for therapeutic use, such as nicotine replacement therapies, would be excluded.
Sponsored by Vitale, a long-time advocate for stronger tobacco control, the bill reflects a continued statewide effort to combat youth nicotine addiction. If enacted, the new penalties would take effect 180 days after being signed into law.
