Panama Enacts Law Banning Use, Import, and Sale of E-Cigarettes

Panama regulates e-cigarette sales use

On June 30, 2022, Panamanian President Laurentino Cortizo signed into law a bill that prohibits the use, import, and commercialization of electronic nicotine delivery systems, e-cigarettes, vaporizers, tobacco heaters, and other similar devices, with or without nicotine, in Panama. The law, known as Law 315, was initially approved by the National Assembly on March 19, 2020, but was vetoed by the President.

The legislative body resumed discussion of the vetoed document in August of the same year and approved it again in a third debate on July 8, 2021. Nearly a year later, President Cortizo has given his approval to the law, which also prohibits the online purchase or promotion of these devices.

The law makes an exception for the import of these products into free zones and free trade areas in Panama, provided that the purpose is for export to a third country. The National Customs Authority is authorized to inspect, detain, seize, and suspend the sale of electronic systems.

National Assembly Approved Ban in July 2021

On July 8, 2021, the National Assembly approved Bill 178 in its third debate, which prohibits the use, import, and commercialization of electronic nicotine delivery systems, e-cigarettes, vaporizers, tobacco heaters, and other similar devices, with or without nicotine, in Panama.

The bill, promoted by the President of the Assembly, Deputy Crispiano Adames, requires owners, managers, or administrators of public and private environments, both open and closed, to display visible signs warning of the prohibition. The signs must indicate that the use of such electronic systems is prohibited and that complaints can be made to 311. The signs must measure at least 8.5 by 14 inches and be placed 1.5 meters above the floor.

The new anti-smoking legislation also establishes that the online purchase or promotion of these devices is prohibited, and that natural or legal persons who carry out sales and promotion activities of these devices in Panama will be sanctioned in accordance with the provisions of the Health Code.
