Poland’s Ministry of Health is preparing a draft law that will prohibit the use of disposable electronic cigarettes, both with and without nicotine, throughout the country. According to the list of legislative and program works of the Council of Ministers, the government is expected to adopt the legislation in the third quarter of 2025.

The justification for implementing a total ban on disposable e-cigarettes in Poland stems from the need to further restrict their use, not only by individuals under 18 years of age but also by adults. The planned regulation is expected to have the greatest impact on young adults, as electronic cigarettes containing nicotine and other substances are considered products that pose a clear threat to public health due to their highly addictive nature and the unexplored health effects of the accompanying substances absorbed into the human body.

The draft law will also include provisions authorizing the president of the Office for Chemical Substances to commission testing of e-cigarette liquid compositions and will provide a list of laboratories authorized to carry out such tests. Additionally, the government aims to legally restrict the emergence of new nicotine products on the market, such as nicotine pouches, allowing only the sale of products containing ingredients that give exclusively the smell or taste of tobacco.

Furthermore, the legislation will clarify regulations prohibiting the sale of gums, tablets, nasal and oral aerosols, and beverages containing nicotine, mandating that they be sold exclusively under pharmaceutical regulations and only after research and registration confirming their effectiveness and safety of use.

The proposed ban on disposable e-cigarettes and the restrictions on new nicotine products demonstrate Poland’s commitment to protecting public health and reducing the potential harm associated with these products, particularly among young adults.
