US Bans Imports and Sales of Njoy Ace Vaping Products

The U.S. International Trade Commission (ITC) has ruled that Njoy Ace vaping products, owned by Altria, violate four patents held by Juul Labs. The decision, announced on Wednesday, prohibits the importation and sale of these devices in the U.S. until the patents expire in 2034 and 2037. The ruling is now under final review by the Office of the U.S. Trade Representative and could take effect as early as March 31, 2025.

Altria Responds to ITC Decision

Altria, which acquired Njoy in March 2023, addressed the ruling in its fourth-quarter earnings report. The company stated that “NJOY continues work on its product solution that addresses all of the patents at issue in the event the ITC’s decision is not rejected by the Trade Representative.” This suggests that Njoy is exploring alternatives to comply with the patent restrictions.

Juul Labs filed patent infringement complaints against Njoy and Altria in July 2023. Tyler Mace, Juul’s Chief Legal Officer, expressed satisfaction with the ITC’s decision: “We are pleased by the ITC’s decision to protect our U.S.-developed innovations against those who seek to import copycat products, principally from China.”

Altria retaliated with its own patent infringement lawsuit against Juul in August 2023, which remains unresolved. The legal battle underscores the intense competition in the U.S. vaping market.

Impact on Njoy’s Market Growth

The ITC ruling could hinder Njoy’s expansion in the U.S. The brand reported a 15.3% year-over-year increase in shipments during the fourth quarter, surpassing 46 million units for 2024. Njoy also achieved a 6.4% market share in the U.S. multi-outlet and convenience channel in Q4.

In June, Njoy received FDA approval for its menthol-flavored e-cigarette, marking a significant milestone. However, the ITC decision may disrupt these gains, especially if the ban takes effect next year.

Broader Implications for the Vaping Industry

The FDA’s recent withdrawal of a proposal to ban menthol cigarettes could open doors for other vape manufacturers to introduce menthol-flavored products. This shift may create new opportunities for competitors, even as Njoy faces legal challenges.
