Vermont bans flavored vapes tobacco products

Vermont Governor Phil Scott has vetoed S.18, legislation that would have banned the sale of all flavored tobacco and vaping products, including menthol cigarettes, in the state. While proponents argued the bill was necessary to discourage youth nicotine addiction, Governor Scott described the measure as “hypocritical.”

In his veto letter to the General Assembly, Scott pointed to policy inconsistencies, noting that Vermont allows the sale of flavored alcohol and cannabis products despite their own risks and appeal. “I’ve found people lose faith in government when policies have these types of inconsistencies,” he stated. He also raised practical concerns, arguing that the products would remain widely available to Vermonters through online sales and purchases in neighboring New Hampshire, which has no such ban. The Joint Fiscal Office estimated the ban would result in a significant state revenue loss of $7-14 million annually. The bill did not pass either legislative chamber with a veto-proof majority, making an override unlikely.
