The new framework dictates that cannabis, along with its resins, extracts, and tinctures, will be moved from a list of strictly banned substances to a table of substances under “strict monitoring.” This reclassification clears the legal path for medical application, allowing patients to access treatments that were previously only obtainable through illicit channels or by traveling abroad.

This legislative breakthrough is the culmination of sustained advocacy from patients, medical professionals, and parliamentarians. Saša Magazinović, a member of the Social Democratic Party in the BiH Parliament, celebrated the victory on social media, stating, “After years of struggle, obstruction, persistence… FINALLY! The Council of Ministers has adopted a decision to legalise cannabis for medical purposes.”

The Role of Advocacy and Personal Stories

The push for legalization was heavily influenced by personal testimonies. Magazinović credited early parliamentary conferences where patients shared their experiences with cannabis oil in treating serious illnesses. He highlighted the influence of Irfan Ribić, a student who used cannabis oil to treat his multiple sclerosis, as a driving force behind the political will to change the law. “There are tears in front of my eyes from the people who are listening to their cry for legalisation of the drug,” Magazinović recalled, emphasizing the emotional weight of the victory.

Strict Controls and Next Steps

While the decision is a major milestone, the new legislation establishes a rigorous control system to ensure safety and prevent misuse. Key regulations include:

  • Prescription Requirement: Patients must obtain a doctor’s prescription and approval.
  • Mandatory Tracking: Implementation of strict record-keeping systems.
  • Supply Chain Control: Regulation of production, distribution, sales, and storage channels.
  • Quality Assurance: Monitoring systems to ensure product safety.

Implementation will be gradual. The Council noted that further amendments to by-laws are needed to define specific conditions for application, a task that falls to the Agency for Medicines and Entity health authorities. As Magazinović cautioned, “The most important step has been taken, but the devil is in the details.” This move positions Bosnia and Herzegovina alongside 21 other European nations that have already adopted medical cannabis programs.
