Vietnam Proposes 10 Million VND Fine for E-Cigarette Use
E-cigarette users in Vietnam could soon face significant administrative fines, potentially reaching up to 10 million VND, under a new draft Decree currently being appraised by the Ministry of Justice. This move follows the National Assembly’s Resolution 173/2024/QH15, which unanimously agreed to ban the production, trading, import, storage, transportation, and use of e-cigarettes and heated tobacco products starting from 2025.

Previously, Vietnam’s legal framework lacked specific administrative penalties for violations related to e-cigarette use. The new draft aims to close this gap. Article 27 of the proposed Decree outlines penalties for such violations, signaling a stricter enforcement approach. Additionally, the draft proposes specific fines for minors; individuals aged 16 to under 18 caught using tobacco products would face fines ranging from 200,000 to 500,000 VND, a shift from the previous regulation which allowed for warnings.

The draft Decree also addresses alcohol-related violations. Under Article 31, actions such as drinking alcohol in prohibited locations or inciting others to drink could incur fines between 500,000 and 1,000,000 VND. If approved, these regulations will mark a significant tightening of health-related administrative sanctions in Vietnam.
