Colombia Proposes Ban on Public Display of Vapes and Cigarettes
Colombia’s Superintendency of Industry and Commerce (SIC) has published a draft resolution proposing severe restrictions on the advertising, display, and sale of tobacco and vaping products. This initiative aims to close a persistent regulatory gap and curb the rising use of electronic nicotine devices, particularly among Colombian youth.
The new proposal is expected to trigger a major debate among public health organizations, tobacco control experts, and the tobacco industry.
For over a decade, ambiguous regulations have allowed tobacco and vape products to be prominently displayed in physical establishments and online platforms. Previously, the SIC maintained that merely displaying a product did not constitute promotion, allowing for visible product placement despite existing advertising bans.
However, the Council of State has recently adopted a different view. Supported by the jurisprudence of the Constitutional Court and the World Health Organization’s Framework Convention on Tobacco Control, the Council argues that the visible display of tobacco products inherently acts as a form of promotion.
By aligning with these stricter public health guidelines, the SIC’s draft resolution seeks to permanently remove cigarettes and vapes from public view, prioritizing youth protection over commercial display practices.
