Italy: Milan City Council Suspends Total Outdoor Smoking Ban
The Milan City Council has temporarily halted a controversial proposal to implement a total outdoor smoking ban. The legislative push collapsed after failing to reach a quorum, driven by intense internal divisions, accusations of prohibitionism, and widespread concerns over the feasibility of enforcing stricter regulations.
The civic list “LaCivica,” spearheaded by Marzia Pontone and Marco Fumagalli, pushed to eliminate the existing 10-meter distance rule that has regulated cigarette, cigar, and pipe smokers since 2025. Notably, vaping and combustion-free products remain exempt from these specific distance restrictions.
The attempt to force a total ban without mediation was met with fierce resistance across the political spectrum. When the council decided to vote on the agenda item by item, the quorum immediately failed on the first point, effectively stalling the initiative.
Opponents of the total ban raised several key arguments during the heated session:
- Enforcement Failures:Â Alessandro De Chirico (Forza Italia) highlighted the “disarming” reality that only 19 fines were issued in a month and a half under the current rules. He argued that local police lack the resources to chase down violators and suggested adopting Japan’s model of designated outdoor smoking areas.
- Ideological Pushback:Â Daniele Nahum (Azione) slammed the move as a return to “prohibitionism,” arguing that the current 10-meter rule is already widely ignored. Similarly, Pietro Celestino (Fratelli d’Italia) labeled the total ban an “attempt to destroy freedom.”
Despite the backlash, proponents refused to compromise. Pontone argued that protecting vulnerable individuals, such as children and the elderly, supersedes the individual right to smoke in public spaces. Supportive voices, including pharmacist Annarosa Racca and doctor Luca Bernardo, emphasized the severe health risks associated with both traditional smoking and vaping substances, urging the council to prioritize public health.
While the total ban stalled, the council did find common ground on environmental measures. A proposal by Alice Arienta to introduce innovative, eco-friendly disposal bins for cigarette butts and e-cigarettes across Milan was accepted.
The broader outdoor smoking ban will be revisited at the next city council meeting. However, given the deep political divide and the failure of mediation efforts, the elimination of the “safety distance” is unlikely to be approved in its current form.
