Scotland Considers 15m Vape Ban Around Schools and Playgrounds
SNP ministers are actively evaluating how to implement the Tobacco and Vapes Act 2026 to crack down on public e-cigarette use. Under proposals pushed by Scottish Labour, vaping and smoking could soon be banned within 15 meters of schools, nurseries, and playgrounds across Scotland.
The UK-wide legislation aims to phase out smoking entirely by banning tobacco sales to anyone born after 2009. For Scotland, the Act also provides specific powers to create designated vape-free and heated tobacco-free spaces.
Currently, NHS Scotland hospitals enforce a strict 100% smoke-free policy. Under a 2022 law, smoking within 15 meters of an NHS hospital building is a punishable offence, carrying a £50 on-the-spot fine (reducible to £30 for prompt payment). Health advocates now want this exact perimeter model applied to educational facilities to ensure children can breathe clean air.
The push for stricter regulations comes amid rising teenage e-cigarette use, which persists despite Scotland’s ban on single-use vapes last year. A recent University of Stirling study revealed that vaping is actively harming education, with students regularly skipping lessons to vape. Teachers have reported spending significant resources patrolling school grounds and toilets to manage escalating nicotine addiction among pupils.
Public Health Minister Maree Todd confirmed that the government is assessing how to deploy these new powers. Todd emphasized that any future restrictions will be evidence-based, proportionate, and subject to public consultation before being presented to Parliament.
