Russia FAS Cracks Down on Illegal Vape and Tobacco Ads

The Federal Antimonopoly Service (FAS) of Russia has initiated legal proceedings against several businesses for illegally advertising alcohol, tobacco, and vaping products. Spanning the Moscow, Orenburg, Tver, and Tomsk regions, these enforcement actions underscore Russia’s tightening grip on public promotions of health-restricted substances.

Under Paragraph 8 of Article 7 of the Russian Federal Law “On Advertising,” any promotion of tobacco, nicotine-containing products, smoking accessories (such as pipes, rolling papers, and lighters), and vape devices is strictly forbidden. Despite these clear boundaries, local authorities continue to uncover creative attempts to bypass the law.

Regional Violations and Regulatory Enforcement

In the Tver region, an entrepreneur in the town of Kalyazin was fined for displaying a street sign featuring the words “niKOTin” (nicotine), “tabak” (tobacco), and “VAPE.” Beyond violating the tobacco advertising ban, the sign violated the Federal Law “On the State Language of the Russian Federation” by failing to provide a Russian translation for the English word “VAPE.”

Meanwhile, in the Orenburg region, authorities targeted mobile advertising. A local business was caught using a vehicle trailer parked in public to promote smoking accessories and nicotine delivery systems. Because the law bans advertising both the products and the sellers of such goods, the business now faces significant fines under the Code of Administrative Offences (KoAP RF).

In Tomsk, a banner mounted on a fence near a building entrance displayed various tobacco products and store addresses without any age restrictions. The Tomsk FAS declared the ad unlawful and ordered its immediate removal.

The crackdown also extended to illegal alcohol promotion. In the Moscow region, a business was penalized for advertising high-strength alcohol (5%+ ABV) inside a shopping mall. Under Russian law, advertising beverages with an alcohol content of 5% or more is strictly restricted to licensed stationary retail points and tasting rooms.

These coordinated actions by regional FAS branches signal an intensified effort to eliminate tobacco and vape visibility from public spaces. Businesses operating in Russia are urged to strictly adhere to advertising laws, ensuring no promotional materials for restricted substances are visible to the general public.
