South Dakota Nicotine Retailers Face November 1 Licensing Deadline
South Dakota tax officials are reminding business owners to secure their required nicotine licenses before the November 1 deadline. The requirement stems from Senate Bill 221, which establishes a framework for the licensing and oversight of all nicotine and vapor product retailers.
Once the law takes effect on January 1, 2027, businesses must hold this specific license alongside their standard sales tax credentials. Fees for the permit are determined by the location and sales volume of nicotine products handled by the retailer.
Non-compliance will result in penalties that intensify with each subsequent infraction. According to the state’s enforcement schedule, a first offense triggers a $500 fine, while a fourth violation within a 36-month period can lead to a $5,500 fine and the revocation of the business’s operating license.
