Portugal Bans Hemp and CBD in Tobacco Products, Restricts to Medical Use
Portugal’s Tax and Customs Authority (AT) has officially prohibited the sale of tobacco products containing cannabis extracts, including CBD and THC, restricting their commercialization strictly to authorized medicinal channels. The directive, issued on November 26, 2025, addresses the influx of CBD cigarettes, hemp pre-rolls, and cannabis-infused vape liquids.
Under this new rule, any product taxed as tobacco that contains cannabis derivatives is banned from general sale, regardless of THC content. The AT cites existing medicinal cannabis regulations, which require authorization from Infarmed (the national medicines agency) for any cannabis sales. This effectively closes the “grey zone” where such items were often sold as “collectibles.”
This move contrasts with other EU nations like Belgium and Luxembourg, which allow low-THC hemp products to be sold as tobacco. Despite Portugal’s reputation for progressive drug policies since decriminalization in 2001, this decision signals a stricter stance on the commercial integration of industrial hemp and CBD.
