Can You Smoke Hemp in Wisconsin Rentals? Legal Guide
For tenants in Wisconsin, the question of whether they can legally smoke hemp or cannabis products on their rental property is becoming increasingly complex. While the state has clear restrictions on tobacco smoking in public spaces, regulations surrounding hemp and cannabis are far less defined, creating a potential gray area for renters and landlords alike.
Wisconsin’s statewide smoking ban, implemented in 2010, prohibits smoking in indoor public spaces, including the common areas of multi-unit residential properties. However, the Wisconsin Department of Health Services clarifies that this law specifically targets cigars, cigarettes, pipes, and other “lighted smoking devices.” Crucially, it does not explicitly mention hemp or cannabis, nor does it currently include e-cigarettes or vapes. This means there is no statewide law specifically banning the smoking of hemp on residential properties.
However, this lack of state regulation does not grant tenants a free pass. Landlords retain the right to include clauses in lease agreements that ban smoking of any kind, including hemp and cannabis, on their properties. Tenants are strongly advised to check their specific lease terms to understand the policies governing their rental.
The Legal Status of Hemp and THC
The context for this issue stems from the 2018 federal Farm Bill, which legalized hemp-derived THC products containing less than 0.3% THC by dry weight. This led to a boom in the availability of cannabinoids like THCA, delta-8, and CBD in Wisconsin. However, the landscape is shifting. In November 2025, a new federal funding bill was signed to close this loophole, limiting legal hemp products to just 0.4 milligrams of THC per container. These new restrictions, set to take effect a year from signing, essentially ban most intoxicating hemp products currently sold in the state.
It is important to distinguish this from marijuana. Recreational and medicinal marijuana use remains illegal in Wisconsin for all ages, despite legalization efforts in neighboring states. While hemp-derived THC and marijuana-derived THC have similar effects, their legal treatment has differed until recent federal moves to tighten controls.
