EU Tobacco Tax Hikes Risk Driving Consumers to Black Market
The European Economic and Social Committee (EESC) issued a formal opinion on February 18, warning that abrupt increases in tobacco taxation could inadvertently fuel the illicit trade. Analyzing the European Commission’s July 2025 directive review, the advisory body argues that excessive levies undermine fiscal revenue and public health goals. The EESC advocates for a “proportionate and gradual” reform that distinguishes between combustible tobacco and non-combustible products like vapers.
The “Less Harm, Lower Tax” Principle
While acknowledging the need to modernize the EU’s “obsolete” legislative framework, the EESC emphasizes a risk-proportionate approach. The committee explicitly recommends against taxing e-cigarettes and heated tobacco at the same levels as traditional cigarettes. By applying the principle of “less harm, lower tax,” the EESC aims to maintain incentives for smokers to transition to potentially less toxic alternatives while preserving Member State flexibility in tax design.
This stance arrives as 15 countries, including Spain, demand a harmonized EU directive to eliminate market fragmentation. The European Commission’s Beating Cancer Plan seeks to reinforce health protection and combat fraud; however, the EESC warns that without “legal quality” in product definitions and improved customs cooperation, the reform may trigger a massive shift toward untaxed, unregulated contraband networks.
Spanish Regulatory Alignment and Market Friction
In Spain, the Council of Ministers recently approved a draft tobacco law that equates e-cigarettes with conventional tobacco and prohibits smoking on terraces. However, the National Markets and Competition Commission (CNMC) has urged the Ministry of Health to reconsider these restrictions. The CNMC suggests exploring “less restrictive alternatives” and aligning Spanish law with the evolving EU framework to minimize adaptation costs for businesses and protect the internal market’s integrity.
