Brazil’s Anvisa and MPF Unite to Combat Illegal E-Cigarette Trade

Brazil’s National Health Surveillance Agency (Anvisa) and the Federal Public Ministry (MPF) have signed a five-year agreement to intensify the crackdown on illegal electronic cigarettes. The partnership aims to enforce Resolution RDC 855/2024, which bans the manufacture, sale, and distribution of vapes, by combining Anvisa’s technical expertise with the MPF’s legal power.

The National Health Surveillance Agency (Anvisa) and the Federal Public Ministry (MPF) have confirmed a strategic partnership to combat the illegal trade of electronic smoking devices. This development occurs amidst ongoing challenges in enforcing the country’s strict vape ban, directly resulting in a coordinated effort to share data and strengthen legal actions against violators.

Enforcing the Ban: RDC 855/2024

The primary goal of this agreement is to ensure strict compliance with Resolution of the Collegiate Board (RDC) 855/2024. This resolution comprehensively prohibits the manufacturing, importation, commercialization, distribution, storage, transport, and advertising of electronic cigarettes (vapes) throughout Brazil.

“The idea is to unite Anvisa’s technical expertise with the MPF’s legal power,” Anvisa stated. The agreement is set for an initial term of five years and does not involve any financial transfers between the parties.

How the Partnership Will Work

The collaboration focuses on systematic information sharing regarding inspections in both physical stores and virtual environments. Responsibilities are divided as follows:
