Argentina: Santa Fe Province Advances Public Vape Ban Bill
The Chamber of Deputies in Santa Fe Province, Argentina, has granted initial approval (“media sanción”) to a bill that seeks to update provincial anti-smoking legislation by incorporating regulations for vaping and e-cigarettes. The initiative, presented by Deputy Sonia Martorano, aims to address the rapid expansion of these new consumption habits, particularly among adolescents and young adults.
The proposal modifies Santa Fe’s existing Law No. 12.432, which has regulated smoking since 2005, to include the prevention and control of e-cigarettes and heated tobacco products. “The electronic cigarette is not harmless. It contains substances that generate addiction and lung damage. That’s why we need a law that protects the new generations,” stated Martorano.
Key points of the proposed legislation include:
- Prohibiting the use of vaping devices in all enclosed public access spaces.
- Banning the sale of e-cigarettes and heated tobacco products to anyone under 18 years of age.
- Expanding the prohibition on advertising, promotion, and sponsorship of brands linked to tobacco or vaping.
- Requiring the Ministries of Health and Education to implement prevention campaigns, school workshops, educational materials, and a free advisory hotline.
- Recognizing addiction to vaping and tobacco as a disease that must be diagnosed and treated within all health systems.
“The project has a comprehensive approach: it educates, prevents, and protects. It’s not just about prohibiting, but about caring for health and supporting those who need to quit the habit,” affirmed Deputy Martorano. With this initial approval, Santa Fe takes a key step towards modernizing its regulations, aligning with WHO standards and national tobacco control policies.
