California Releases First “Unflavored Tobacco List” to Enforce Flavor Ban
California has taken a significant step in enforcing its flavored tobacco ban by unveiling its first-ever “Unflavored Tobacco List.” This registry clarifies which tobacco and nicotine products are eligible for legal sale within the state. Under the new regulations, any product not included on this list is automatically deemed a flavored product and is therefore banned from being sold.
The creation of this list was mandated by a 2024 state law intended to refine the definition of flavored tobacco products, following the initial ban enacted in 2022. California Attorney General Rob Bonta emphasized the move as a priority for safeguarding public health, stating, “The Unflavored Tobacco List will help further reduce tobacco use among young people and strengthen accountability for companies and individuals who break our laws.”
The list covers traditional tobacco, nicotine products, e-cigarettes, and vapes. Major manufacturers, including Marlboro, Camel, Juul, and Zyn, have secured spots on the list and are permitted to continue sales. The California Department of Justice has advised local law enforcement to initially focus on “obviously flavored” items like fruit and menthol products, prioritizing education for manufacturers. However, they warned that unregistered products not on the list are subject to seizure and fines. Certain items, such as hookah products, loose-leaf pipe tobacco, and premium cigars, are exempt from the list requirement.
