Arkansas to Restrict Most Vape Sales Under New Law (Act 590)
A new Arkansas law, Act 590, is set to significantly limit the sale of vape products across the state, targeting closed-system, single-use disposable vapes and e-liquids containing nicotine. Under the new regulations, vendors will only be permitted to sell products that are either authorized by or currently under review by the U.S. Food and Drug Administration (FDA).
Scott Hardin, spokesperson for Arkansas Tobacco Control (ATC), stated, “There are products from across the world that are being sold at these retailers and frankly we don’t know what’s in them.” The ATC will publish a list of approved products for sale. Hardin noted that while the FDA has only authorized 39 e-cigarette products nationally, the ATC has so far approved nine of about a dozen applications for the state’s list.
The law also aims to protect children by restricting marketing. Effective August 5, vape products cannot imitate designs or packaging that appeal to minors, such as cartoons or candy names. While the law takes effect on September 1, sellers have until November 1 before full enforcement begins. Violators face product seizure, significant fines, and potential permit revocation.
