California to Enforce “Unflavored Tobacco List” in 2026
California is moving forward with the next phase of its flavored tobacco product enforcement by establishing an The California Department of Justice (DOJ) has announced its enforcement priorities for the state’s upcoming Unflavored Tobacco List (UTL), a new regulatory tool designed to enforce California’s ban on most flavored tobacco and vaping products. The first version of the UTL is set to be published by December 31, 2025.
In a recent bulletin, the DOJ clarified that upon the UTL’s launch, its primary enforcement focus will be on “obviously flavored” products. This category includes items with non-tobacco flavors like menthol or fruit in their trade names, or products previously identified by the Attorney General’s office as “flavored.” For tobacco and vape products that are not on the initial UTL but are not “obviously flavored” (such as some hand-rolled cigars), the DOJ intends to initially focus on educating manufacturers about the registration process rather than taking immediate enforcement action.
This UTL was established by Assembly Bill 3218 (2024), which directs the Attorney General to create a public list of unflavored tobacco products legal for sale in California. If a product is not on the list, it is likely illegal to sell and subject to seizure and fines up to $10,000 per violation. The registration process, which required initial submissions by October 9th, involves paperwork, physical samples, and a $300 fee. The Attorney General’s office is also seeking to make the UTL’s emergency regulations permanent, with a public hearing scheduled for December 23rd. This move aims to provide clarity for retailers and law enforcement in a market where the vast majority of available vaping products lack FDA authorization and are thus in a federal legal gray area.
