Costa Rica MP Proposes Total Ban on Vape Sales & Use
Ada Acuña, a deputy from Costa Rica’s ruling Social Democratic Progress Party (PPSD), has introduced a bill aiming to completely prohibit the use, consumption, importation, and sale of vaping devices in the country. The initiative, filed under dossier 25.309, seeks to ban all activities related to electronic nicotine delivery systems (ENDS), similar non-nicotine systems (ENNDS), and heated tobacco devices, including their components and accessories.
The proposal also calls for the repeal of the existing law regulating these products, which Acuña deems a “failure” due to a lack of control, particularly regarding youth access. She highlighted reports of minors easily acquiring vapes through delivery services without age verification and noted 25 cases of intoxication this year, mostly among children aged 10 to 17. The bill would mandate the Ministry of Health to issue a list of prohibited substances associated with these devices.
Acuña’s proposal aligns with similar bans in other Latin American countries like Mexico, Brazil, and Argentina. However, the repeal of the current law would also eliminate a specific 20% tax on vape products intended to fund high-cost medications for tobacco-related illnesses. Acuña stated that the financial implications of removing this tax would need to be analyzed in consultation with the Ministry of Finance and the Costa Rican Social Security Fund (CCSS).
