Mexico Considers Full Vape Ban with Prison Penalties
Mexico’s Chamber of Deputies has begun the legislative process for a comprehensive presidential initiative aimed at reforming the General Health Law, with a central component being the total prohibition of electronic cigarettes, vapes, and similar devices. The proposal was formally turned over to an internal commission for analysis on Tuesday, September 30th, marking the start of its legislative review.
The proposed reform seeks to completely ban the use and commercialization of all vaping systems. To enforce this, the initiative includes significant penalties, including potential prison sentences of up to eight years and fines of up to 200,000 pesos for individuals or legal entities that distribute, sell, or promote the prohibited devices. This represents a major escalation in the country’s efforts to control the vape market.
The legislative package is part of a broader strategy to strengthen the state’s public health actions through enhanced sanitary security and institutional control. Beyond the vape ban, the reform also includes provisions to regulate the handling of toxic substances, such as fentanyl, and measures to modernize the public health system. These include streamlining the acquisition of medicines and the digitalization of clinical records to improve the healthcare system’s responsiveness.
The initiative will now be reviewed by the corresponding commission, which will issue a report for subsequent discussion and a vote in the full Chamber. If approved by a majority, the reform will then advance to the Senate to complete the legislative process.
