Senator Durbin Urges RFK Jr. to Halt Easing of Flavored Vape Rules
U.S. Senator Dick Durbin has formally urged Health Secretary Robert F. Kennedy Jr. to resist the recent easing of regulations on flavored vapes. This pushback comes amid controversial FDA policy shifts, which Durbin claims prioritize Big Tobacco lobbying over the protection of children from nicotine addiction.
The U.S. Food and Drug Administration (FDA) has notably softened its stance on flavored vapes in recent weeks. This shift, reportedly influenced by White House pressure, contributed to the resignation of Commissioner Marty Makary and reignited national debates over vaping regulations.
In a letter reviewed by Reuters, Senator Durbin condemned the regulatory changes as “short-sighted” and “corrupt.” He argued that the FDA’s moves directly benefit major tobacco corporations at the expense of youth health.
The controversy centers on two major FDA actions:
- Authorizing the sale of fruit-flavored vapes for the first time.
- Outlining plans to allow certain vapes and nicotine pouches to reach retail shelves before undergoing full inspection by FDA scientists, bypassing a long-standing requirement for manufacturers to prove a public health benefit prior to sale.
While the nicotine industry maintains that flavored vapes help traditional smokers quit, Durbin and other critics warn of their strong appeal to young people.
Durbin highlighted significant political contributions as the catalyst for these changes. Federal Election Commission data reveals that Reynolds American, the U.S. unit of British American Tobacco (BAT), donated $10 million to a Trump-aligned super PAC in 2024.
In defense of the policy, a White House spokesperson stated that “gold standard science” guides the administration’s health decisions. Furthermore, the Department of Health and Human Services clarified that only specific products equipped with youth-prevention technology would qualify for pre-review sales.
Continuing the legislative pressure, Durbin and nine other senators sent a separate letter to acting FDA Commissioner Kyle Diamantas on May 15, demanding the rescission of marketing authorizations for fruit-flavored vapes.
