Juul Labs Files New Patent Infringement Lawsuits Against NJOY and Altria
Juul Labs has escalated its legal battle with competitors NJOY and its parent company, Altria, by filing new patent infringement complaints with the U.S. International Trade Commission (ITC) and the U.S. District Court for the District of Arizona. The latest lawsuits allege that the NJOY DAILY vapor product infringes on a patent owned by Juul Labs.
This action is the most recent development in a series of disputes that began after Altria divested its stake in Juul Labs in 2023 and subsequently acquired NJOY. Juul contends that Altria chose not to license its intellectual property and instead acquired NJOY, whose Chinese-developed products allegedly infringe on Juul’s patented technology.
These new complaints follow Juul Labs’ significant victories earlier this year. The ITC previously found that Altria’s NJOY ACE vapor product infringed four of Juul’s patents, leading to a ban on its importation into the United States. In the same month, the ITC terminated a separate patent infringement case brought by Altria against Juul, finding no infringement had occurred. Altria has reportedly informed Juul Labs of its intention to reactivate federal court litigation based on the same patents from its failed ITC action.
Juul Labs stated it welcomes fair competition in its mission to eliminate combustible cigarettes but is committed to defending its technology and protecting American innovation.
