Kentucky Enacts Strict New Vape and Tobacco Licensing Law
Kentucky has officially enacted an emergency law (Acts Ch. 70) establishing a comprehensive, mandatory licensing framework for all tobacco, nicotine, and vape retailers operating within the state.
- Rapid Implementation: The Department of Alcoholic Beverage Control (ABC) must publish application forms and rules within 30 days.
- Strict Deadline: Unlicensed retailers currently selling these products have exactly 60 days to submit their applications and fees.
- Streamlined Renewals: A new “batch license” allows businesses to renew their vape and existing liquor licenses simultaneously.
Kentucky has officially enacted an emergency bill establishing a stringent licensing system for all tobacco, nicotine, and vape products. Signed by the Governor on April 10, 2026, as Acts Ch. 70, the legislation mandates immediate regulatory oversight by the Department of Alcoholic Beverage Control (ABC).
Under the new framework, the ABC is prohibited from imposing extra-legal requirements but must publish official application forms and administrative regulations on its website within 30 days of the law’s effective date.
For businesses currently selling vaping or tobacco products without a permit, the clock is ticking. These retailers must submit their initial applications and pay the required fees within a strict 60-day window.
To ease the administrative burden, the law introduces a “batch license” system. This allows retailers who already hold liquor licenses to renew their alcohol and vape permits simultaneously using a unified form, though fees are calculated based on the number of locations.
Additionally, the legislation outlines rules for ownership changes, provides grace periods for application errors, and makes certain clauses retroactively applicable to January 1, 2026.
